According to the marriage contract, Noberto got married to a certain Gina M. Gaerlan (Gina) on the 17th of July 1987, seven years before they got married. Following that, Alice filed a criminal complaint for bigamy against him. However, Norberto Vitangcol presented a certification as evidence which stated that the office of the civil registrar does not have any record of the marriage license allegedly issued in his favor and Gina M. Gaerlan.

He further argued that his first marriage was void as there is no proof of the existence of its marriage license, hence, he is not guilty of bigamy. Another thing that established the crime of bigamy, in this case, was that Vitangcol failed to file a judicial declaration of nullity of his first marriage.

So, according to the supreme court ruling, that a marriage license certificate cannot be found does not in any way mean that it does not exist. It stated that the document with greater acceptance is the signed marriage contract which bears the marriage license number. “The certification of “cannot be found” will not exculpate him from bigamy”, the court ruled.

They, after all, got divorced, although the details of it and exactly when they finalized the processes are not known. While speaking to Karen Davila during an interview, the business magnate admitted that it was quite not an easy decision to leave her marriage as she would have chosen to do it, at least when their children were more grown and mature.
